Probate Court is an incremental part of the United States justice system that functions as the place for issues such as the execution of wills, the issuance of marriage licenses, firearm licenses, and other matters that can be handled in a small court. The Probate Court Judge is elected by the voters for four year terms.
The Probate Court is a court of exclusive jurisdiction responsible for the probating or proving of all wills of Peach County residents. The Probate Court is also responsible for appointing guardians of minors and incompetent persons, issuing marriage licenses, and issuing firearm, fireworks, and explosive permits. In addition, this elected office also records birth, death, and marriage certificates as the state appointed custodian of vital records for the county, hears misdemeanor traffic cases, game and fish cases, and drug cases, and collects county and state traffic fines. The Probate Court also administers oaths to public officers, files, approves, and records bonds of public officers, and administers estate matters. It is a court of record, so all documents filed here must be recorded in minute books and kept permanently available to the public.
Probate Court is located on the second floor of the Peach County Courthouse and is open from 8 a.m. to 5 p.m. Monday through Friday. You may come in anytime to apply for a marriage license, firearms license, copies of vital records and to file documents for estates and guardianships.
